Is Damiana illegal in North Carolina?

I know the legality of "spice" (which I don't think Damiana is since it is its own herb by itself) varies from state to state in the US and I do know that they made all spice and bath salts illegal in North Carolina recently. So does this include Damiana leaf? I haven't seen anywhere saying it is illegal and many places online sell it legally, but then again in the US the legality of it varies from state to state.
